By accessing or using the website located at movinggenie.nyc (the "Site") or by requesting, scheduling, or using any moving, junk removal, packing, or related services from The Moving Genie LLC ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.
IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU MUST NOT USE THIS SITE OR ENGAGE THE COMPANY'S SERVICES.
These Terms constitute a legally binding agreement. We recommend you read them carefully and retain a copy for your records. Customers who engage services will also receive service-specific documents including an Order for Service, Bill of Lading, and, for applicable moves, the New York State Department of Transportation (NYSDOT) Summary of Information for Shippers.

2.2 State Licensing — NYSDOT
The Moving Genie LLC is licensed by the New York State Department of Transportation (NYSDOT) to transport household goods within New York State. All intrastate moves are governed by New York Transportation Law and NYSDOT regulations. Our filed tariff, which sets forth all applicable rates and charges for intrastate moves, is on file with NYSDOT and available for your inspection upon request.
Under NYSDOT rules, we may only charge rates and apply charges that are contained in our filed tariff. Any charges not appearing in our tariff are null and void.
2.3 Federal Authority — FMCSA (Interstate Moves)
For moves that cross state lines (including moves between New York, New Jersey, and Connecticut), The Moving Genie LLC operates under authority granted by the Federal Motor Carrier Safety Administration (FMCSA):

3. Use of This Website
3.1 Permitted Use
This Site is provided for lawful informational and commercial purposes only. You may use the Site to learn about our services, request quotes, and contact us for moving services. You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to any portion of the Site or its related systems;
- Transmit any harmful, offensive, spam, or disruptive content through any contact form or communication channel on the Site;
- Scrape, harvest, or extract data from the Site using automated tools;
- Misrepresent your identity or provide false information when requesting a quote or service.
3.2 No Binding Quotes Via Website
Any pricing information, cost estimates, or rate ranges displayed on this Site are provided for general informational purposes only and do not constitute a binding quote, offer, or contract. Actual pricing for your move will depend on factors including but not limited to: distance, volume/weight of goods, labor required, access conditions, special handling needs, and applicable tariff rates on file with NYSDOT.
A binding or non-binding written estimate will be provided to you separately following an in-home or virtual survey or upon receipt of sufficient information to prepare an accurate estimate. No binding commitment to any price is made through this website.
3.3 Accuracy of Information
We make reasonable efforts to keep the information on this Site accurate and current. However, we do not warrant that all content is complete, accurate, current, or free of errors. Services, pricing, availability, and service areas are subject to change without prior notice. Always confirm current service availability and pricing directly with our team.
4. Services
4.1 Description of Services
The Moving Genie LLC provides the following moving and related services in Queens, NYC Metro, Nassau County, and the Tri-State Area (NY/NJ/CT), subject to availability and applicable regulatory authority:
- Residential Moving (local and long distance)
- Commercial / Office Moving
- Junk Removal and Hauling
- Packing and Unpacking
- Specialty and Fragile Item Handling
4.2 Service Agreement Documents
When you book a move with us, you will receive service-specific documents that form the operative agreement for your move. These include:
- Order for Service: Issued before loading any goods. Lists all estimated costs, services to be performed, pickup and delivery dates, and other material terms. You have the right to receive this document before the move begins.
- Bill of Lading: Issued at time of loading. Serves as the receipt for your goods and the binding contract for the move. You must sign the Bill of Lading before goods are loaded.
- Inventory / Condition Report: Documents the condition of items at pickup. Review carefully and note any discrepancies before signing.
- NYSDOT Summary of Information for Shippers (intrastate moves): Explains your rights and the mover's responsibilities under New York law. We are required to provide this document to every customer.
- FMCSA 'Your Rights and Responsibilities When You Move' (interstate moves): Federal required disclosure for all interstate household goods moves.
These documents, once signed, together with these Terms of Service, constitute the complete agreement for your move. In the event of any conflict between these Terms and a signed Order for Service or Bill of Lading, the signed Order for Service or Bill of Lading shall control with respect to the specific move.
5. Booking, Estimates & Payment
5.1 Estimates
We provide estimates on a non-binding or binding basis, as specified in writing at the time of the estimate:
- Non-Binding Estimate: An approximation of the cost based on the information provided. Final charges are based on actual services performed, time, and/or weight, consistent with our filed tariff. For non-binding interstate estimates, you are not required to pay more than 110% of the non-binding estimate at time of delivery.
- Binding Estimate: A guaranteed price for services as specified, provided the shipment and services match those described in the estimate. Binding estimates must be in writing and signed by an authorized representative.
5.2 Deposits & Payment
Payment terms, accepted methods, and deposit requirements will be specified in your Order for Service. We accept [cash / check / credit card / electronic payment — confirm with client]. All charges must conform to the rates set forth in our NYSDOT-filed tariff for intrastate moves. We do not charge for any service not shown in our tariff.
For interstate moves, federal law limits the amount we may collect at time of delivery on non-binding estimates to no more than 110% of the estimated amount. The balance of any additional charges will be billed within 30 days of delivery.
5.3 Cancellations & Rescheduling
You may cancel or reschedule your move by contacting us at (212) 484-1095 or info@movinggenie.nyc. Specific cancellation and rescheduling terms, including any applicable fees, will be specified in your Order for Service. We strongly encourage advance notice of at least [48–72 hours — confirm with client] for cancellations or changes to avoid forfeiture of any deposit.
6. Liability, Valuation & Claims
6.1 Valuation Options
Under both New York state law and federal FMCSA regulations, you have the right to select the level of protection (valuation) for your goods:
- Released Value / Basic Carrier Liability: The minimum liability level, provided at no charge. For intrastate NY moves, liability is limited as set forth in our filed tariff. For interstate moves, this is typically $0.60 per pound per article under FMCSA released value protection. This is NOT insurance.
- Full Value Protection (Declared Value): If you declare a specific value for your shipment, we will provide Full Value Protection as specified in our tariff or estimate. Additional charges may apply. See your Order for Service and Bill of Lading for details.
You are encouraged to review your homeowner's, renter's, or property insurance policy to determine whether it covers goods in transit.
The basic liability we provide under Released Value is NOT equivalent to full replacement cost insurance and may not fully cover the value of your items. We strongly recommend you consider purchasing full value protection or obtaining third-party moving insurance.
6.2 Filing a Claim
If any of your goods are lost, damaged, or destroyed during your move, you must:
- Note any visible damage on the inventory or Bill of Lading at the time of delivery. Failure to do so may limit your ability to recover for visible damage.
- Submit a written claim to us within the timeframe specified in your Bill of Lading and/or as required by law. For intrastate NY moves, timelines are set forth in our filed tariff. For interstate moves, you have 9 months from the date of delivery to file a claim.
- We are required by NYSDOT rules to acknowledge your claim in writing within 30 days of receipt and to resolve or deny the claim within 120 days.

If we are unable to resolve a claim satisfactorily, you may file a complaint with NYSDOT (for intrastate moves) at (518) 457-6512 or nymoving@dot.ny.gov, or pursue the matter in Small Claims Court. For interstate moves, you may contact the FMCSA at 1-888-368-7238 or at protectyourmove.gov.
6.3 Items We Cannot Move
We are not responsible for and will not move the following categories of items unless separately agreed in writing:
- Hazardous materials, explosives, flammable liquids, compressed gas, or other dangerous goods regulated by federal, state, or local law;
- Perishable food items;
- Pets or live animals;
- Plants (for long-distance moves);
- Irreplaceable or sentimental items, including but not limited to: cash, jewelry, financial instruments, passports, medications, and legal documents — these should be personally transported;
- Stolen or illegal property.
6.4 High-Value Articles
You must disclose in writing on the Bill of Lading any article valued at more than $100 per pound (e.g., artwork, antiques, jewelry, electronics). Our liability for undisclosed high-value articles is limited to the applicable tariff rate per pound. We may decline to transport certain high-value items or require special handling arrangements.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- OUR LIABILITY FOR LOSS OF OR DAMAGE TO YOUR GOODS IS LIMITED TO THE VALUATION LEVEL SELECTED BY YOU AND DOCUMENTED IN YOUR BILL OF LADING AND TARIFF. NO LIABILITY BEYOND THE APPLICABLE VALUATION LEVEL WILL APPLY.
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO ANY MOVE OR SERVICE, INCLUDING BUT NOT LIMITED TO: LOST INCOME, BUSINESS INTERRUPTION, EMOTIONAL DISTRESS, OR COSTS OF TEMPORARY HOUSING OR STORAGE.
- WE SHALL NOT BE LIABLE FOR DELAYS, LOSSES, OR DAMAGES CAUSED BY CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO: ACTS OF GOD, EXTREME WEATHER, TRAFFIC CONDITIONS, BUILDING ACCESS RESTRICTIONS, LABOR DISPUTES, GOVERNMENT ORDERS, OR ACTS OF THIRD PARTIES.
- OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF YOUR MOVE SHALL NOT EXCEED THE GREATER OF: (A) THE DECLARED/RELEASED VALUE OF YOUR SHIPMENT, OR (B) THE TOTAL AMOUNT PAID BY YOU FOR THE MOVE IN QUESTION.
Nothing in these Terms limits our liability where such limitation is prohibited by law, including applicable federal or New York state consumer protection laws.

All content on this Site — including text, images, graphics, logos, and design elements — is the property of The Moving Genie LLC or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or use any content from this Site for commercial purposes without our prior written consent.

This Site may contain links to third-party websites, platforms, or resources (such as Google Maps, review platforms, or government agency sites). These links are provided for your convenience only. We do not control, endorse, or assume responsibility for the content, accuracy, or privacy practices of any third-party site. Accessing any third-party site through our website is at your own risk.

10.3 Governing Law & Venue
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms that is not resolved through informal means or small claims court shall be brought exclusively in the state or federal courts located in Nassau County or New York County, New York.
10.4 Waiver of Class Action
To the extent permitted by applicable law, you agree that any dispute will be resolved on an individual basis and not as part of a class action, collective action, or representative proceeding.
11. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this Site with an updated Effective Date. Your continued use of the Site or our services after the posting of changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed. The remaining provisions of these Terms shall remain in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy and any signed Order for Service, Bill of Lading, or written estimate applicable to your specific move, constitute the entire agreement between you and The Moving Genie LLC with respect to the subject matter herein and supersede all prior or contemporaneous agreements, representations, or understandings, whether oral or written.
